Welcome to MY REALTOR (myrealtor.africa)! These Terms of Service (“Terms”) govern your access to and use of the MY REALTOR websites (myrealtor.ug, myrealtor.co.ke, myrealtor.africa, etc) and services (collectively referred to as the “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Services.

1.    Use of Our Services

1.1 Eligibility

You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you meet this eligibility requirement.

1.2 Account Registration

To access certain features of our Services, such as listing properties, you may be required to create an account on MY REALTOR platforms. You agree to provide accurate, complete, and up-to-date information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.3 Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates any applicable local, national, or international law or regulation.
• Post, upload, or transmit any content that is defamatory, obscene, offensive, or otherwise objectionable.
• Impersonate or attempt to impersonate MY REALTOR, a MY REALTOR employee, another user, or any other person or entity.
• Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Services.

1.4 Prohibited Activities

You agree not to:

• Use automated means (such as bots) to access the Services on MY REALTOR platforms.
• Harvest or collect information from the Services for any unauthorized purpose.
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Services.

2.    Property Listings

2.1 Listing Responsibilities

If you list a property on any MY REALTOR platform, you are responsible for ensuring that the listing is accurate, truthful and complies with all applicable laws and regulations. You agree to promptly update your listing if any information changes.

MY REALTOR reserves the right to edit or remove any listings that are found to contain false or misleading information.

2.2Listing Availability

All properties listed on MY REALTOR platforms must be currently available for rent or sale. Property owners and agents are required to immediately update the listing when a property is no longer available or mark it as unavailable. Failure to remove or update listings for unavailable properties may result in the removal of the listing and/or termination of the user’s account.

2.3 Prohibited Listings

You may not list properties that are illegal, fraudulent, or otherwise prohibited by law. MY REALTOR reserves the right to remove any listing that violates these Terms or is deemed inappropriate at our discretion.

2.4 Listing Promotion

MY REALTOR may promote certain listings on social media or other platforms. By listing a property, you grant MY REALTOR permission to use your listing for promotional purposes.

2.5 Company-Generated Listings

In addition to user-submitted listings, MY REALTOR may also conduct independent research to create and publish property listings. These company-generated listings are created based on publicly available data and are intended to enhance the comprehensiveness of our platform. While we strive to ensure accuracy, we encourage property seekers to verify all information directly with property owners or agents.

If a property owner wishes to have a company-generated listing removed or requires adjustments to the listing, they may contact us directly at support@myrealtor.africa. We will promptly take action to remove or edit the listing as requested.

3.    Property Seekers/House Hunters

3.1 Use of Listings

As a property seeker or house hunter, you may use the listings on MY REALTOR websites to search for properties. You agree to use the information provided in the listings solely for personal, non-commercial purposes unless otherwise permitted by these Terms.

3.2 Accuracy of Listings

While MY REALTOR strives to ensure that property listings are accurate and up-to-date, we do not warrant or guarantee the accuracy, completeness, or reliability of any listing. It is your responsibility to verify the information before making any decisions based on the listings.

3.3 Communication with Property Owners

MY REALTOR provides a platform for connecting property seekers with property owners, realtors, or agents. However, we are not responsible for the interactions, transactions, or agreements between you and property owners. You are solely responsible for conducting any necessary due diligence before entering into any agreements or transactions.

4.    Fees and Payments

4.1 Free Listings

Currently, MY REALTOR offers free property listings on MY REALTOR platforms. However, we reserve the right to introduce fees for certain features or services in the future. We will provide notice of any fee changes in accordance with these Terms.

4.2 Payment Terms

If you purchase any paid services, you agree to pay all applicable fees in accordance with the payment terms provided at the time of purchase. All fees are non-refundable unless otherwise stated.

5.    Intellectual Property

5.1 Ownership

All content and materials on MY REALTOR platforms, including text, graphics, logos, and software, are the property of MY REALTOR or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

By posting or uploading content to the Services, you grant MY REALTOR a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, distribute, and display such content in connection with the Services.

6.    Disclaimers and Limitations of Liability

6.1 Disclaimer of Warranties

The Services are provided “as is” and “as available,” without any warranties of any kind, either express or implied. MY REALTOR does not warrant that the Services on MY REALTOR platforms will be uninterrupted, error-free, or secure.

6.2 Limitation of Liability

To the fullest extent permitted by law, MY REALTOR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with the Services or these Terms.

7.    Termination

7.1 Termination by You

You may terminate your account at any time by contacting us at support@myrealtor.africa . Upon termination, your right to use the Services on MY REALTOR platforms will immediately cease.

7.2 Termination by MY REALTOR

We may terminate or suspend your account or access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

8.    Governing Law

These Terms are governed by and construed in accordance with the laws of the countries under whick MY REALTOR operates in, without regard to its conflict of law principles.

9.    Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice on MY REALTOR platforms. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
